General

The Site is a shopping website where you can browse, select and purchase Products from Sunshades Eyewear PTY LTD, trading as The Eyewear Index Shop ABN 70102239430 (“The Eyewear Index”, “us” or “we”). Your access to and use of the Site, including your orders and purchases of Products through the Site, is governed by these terms and conditions.

Compliance
You agree to be bound by, and comply with, these terms and conditions, comply with all relevant laws relating to your use of the Site and your placement of any order through the Site and not to use any data listed on the site for commercial purposes e.g. through price or information scraping.

Your Account
If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You must be 18 years or older to purchase Products through the Site. The Eyewear Index reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

Placing an order for Products
You may purchase Products by selecting and submitting your order through the Site in accordance with these terms and conditions. Any order placed through this Site for a Product is an offer by you to purchase the particular Product for the price notified (including the delivery and other charges, fees and taxes) at the time you place the order. We may ask you to provide additional details or require you to confirm your details to enable us to process any orders.
When you order from us, we require you to provide your name, address for delivery, your email address, telephone contact and credit card details. We undertake to take due care with this information; however, in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.

Rejection of an order
Where a product has been listed at the incorrect price or with incorrect descriptive information or image due to typographical error or similar oversight, we reserve the right to cancel a transaction. Where your credit card has been charged, we will immediately refund your credit card for the total amount debited.

Delivery of Products
We will only deliver Products ordered through the Site to a location where we provide delivery services. Our delivery company may need to contact you to arrange a delivery date for certain products. For further information please see our Shipping Information.

An appropriate person must be present to accept the delivery of your order. We may require the person accepting the delivery of your order to provide us with proof of that person’s identity (including photographic identification) and, where relevant, age. If there is no appropriate person at the Delivery Address to receive the order then we will not deliver the Products you have ordered. In this instance, we will endeavour to contact you or you may contact us to arrange for delivery at a different time, and we may charge you an additional Delivery Fee for that replacement delivery. If we are concerned re the credit card used we will hold the order to be able to check all information and will not clear until advised by Credit Card Company.

Cancelling an order
We may cancel any part of an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if the Products in that order are not available, there is an error in the price or the product description posted on the Site for the Product in that order or your order has been placed in breach of these terms and conditions.

Fees and charges
You agree to pay the purchase price of each Product that is ordered, the delivery fee for your order that we notify to you when you place your order (“Delivery Fee”) and any other fees and charges set out in these terms and conditions.

All fees and charges identified in these terms and conditions and all prices for the Products include GST where applicable.

Prices for Products change from time to time and we do not provide any notice of these changes. Subject to these terms and conditions (in particular, our right to cancel an order if there is an error in the price or the product description posted on the Site for the Product in that order), once we have accepted your order, we will not change any prices that apply to the Products in that order.

Duties and Taxes
The Australian GST tax rate applies to all orders delivered within Australia.
International orders are exempt from Australian GST (10%); however, the order may incur taxes and duties applied by customs in the country of delivery. For further information please see our Terms and Conditions – Duties and Taxes
If you require further information Regarding import duty and taxes please contact your local authority for information and guidance. To comply with Australian export regulations, we are required to declare the exact value of all items ordered and to mark them as dutiable ‘merchandise’. We are also prohibited by law from marking the order as a ‘gift’, even if order is placed with the intention of sending to a gift recipient.

Order Quantities
All stock levels shown on the The Eyewear Index website are approximate only and The Eyewear Index does not guarantee that all models of glasses will be available at the time of ordering. The Eyewear Index is not responsible for any loss incurred from stock not being available.

E-Gift Cards
Eyewear Index E-Gift Cards are non-refundable and cannot be redeemed for cash, except where required by Australian Consumer Law. They cannot be cancelled, returned or exchanged for change of mind, incorrect purchase or any unused balance.

E-Gift Cards are valid for three (3) years from the date of purchase. Any remaining balance after expiry will be forfeited.

E-Gift Cards may only be redeemed on the issuing website and cannot be used to purchase additional gift cards. If the order value exceeds the E-Gift Card balance, the remaining amount must be paid using another payment method.

Refunds for purchases made using an E-Gift Card will be issued back to an E-Gift Card, not cash, except where required by law.

E-Gift Cards should be treated like cash. Eyewear Index is not responsible for lost, stolen or unauthorised use, including where incorrect recipient details are provided.

Eyewear Index reserves the right to cancel or void any E-Gift Card where fraud, misuse or suspicious activity is suspected.

Nothing in these Terms and Conditions excludes any rights under Australian Consumer Law.

Risk of Loss
Risk and title to Product passes to you on the date and time of delivery to the delivery address.

Viruses
The Eyewear Index cannot guarantee that any file or program available for download and/or execution from or via this website is free from viruses or other conditions which could damage or interfere with data, hardware or software with which it might be used. You assume all risk of use of all programs and files on this website, and you release Sunshades Eyewear entirely of all responsibility for any consequences of its use.

Terms and Conditions

Promoter
The promoter is Eyewear Index ABN 63 690 894 010 trading as Eyewear Index, of DFO Homebush 3-5 Underwood Rd, Homebush NSW 2140 (“Promoter”).

2. Promotion period
The promotion opens at 12.01am on 4th November 2026 and closes at 11.59pm on 8th November 2026 (“Promotion Period”). All times are Sydney local time.

3. Eligibility
Entry is open to NSW residents aged 18 years or over who make an eligible purchase during the Promotion Period.
Employees and management of the Promoter, anyone involved in organising or conducting the promotion, and their immediate family members are not eligible to enter. Immediate family means a spouse, partner, parent, child or sibling.

4. How to enter
Purchase any pair of Gucci sunglasses in person at Eyewear Index during the Promotion Period.
Each eligible pair purchased entitles the purchaser to one entry. Multiple entries are permitted for multiple eligible pairs purchased, including pairs purchased in the same transaction.
To record the entry, provide your full name, telephone number and email address to store staff at the time of purchase. Staff will record one entry for each eligible pair against the relevant receipt number. Customers may decline entry.
Online purchases, purchases made outside the Promotion Period, gift card purchases and purchases of brands other than Gucci do not qualify.
The sunglasses must be purchased at their normal retail value. There is no additional entry fee.
Entrants must retain their purchase receipt. Entries cannot be transferred to another person.

5. Prize
There is one prize: one new, genuine Gucci handbag, [model, style code, colour and size], with a total recommended retail value of AUD $2,000, including GST, as at 29th October 2026.
The total prize pool is AUD $2,000. Any accessories pictured are excluded unless expressly included in the prize description.
The prize is not transferable or redeemable for cash. Any replacement prize will only be provided by agreement with the winner and in accordance with applicable law.

6. Prize draw
The draw will take place at 10am on 10th November at 110A McEvoy Street, Alexandria NSW 2015
One winner will be selected randomly from all valid entries received during the Promotion Period using a random electronic selection. Each valid entry has an equal chance of winning.
If an entry drawn is invalid or the entrant is ineligible, another entry will be drawn.

7. Winner notification and prize collection
The Promoter will contact the winner by email within two business days of the draw and make reasonable further attempts if the winner does not respond.
The winner must claim the prize by 30th November 2026
Before awarding the prize, the Promoter may reasonably request proof of identity, age, NSW residency and the qualifying purchase.
The prize will be available for collection from Eyewear Index, of DFO Homebush 3-5 Underwood Rd, Homebush NSW 2140 within 28 days after the winner’s eligibility and claim are confirmed. Collection will be free of charge. Another person may collect with the winner’s written authorisation and suitable identification.

8. Unclaimed prize
If the prize remains unclaimed by the claim deadline despite reasonable attempts to contact the winner, the winner will forfeit the prize.
An unclaimed prize draw will take place at 10am on Thursday 3rd November at 110A McEvoy Street Alexandria NSW 2015 using the same random selection method. The original winning entry will be excluded.
The replacement winner will be notified within two business days and will have three months from the redraw to claim. If necessary, this process will be repeated until the prize is awarded.

9. Entry verification and returns
The Promoter may reject entries that are fraudulent, duplicated beyond the permitted entry allowance, or do not meet these terms. Reasonable verification requests will be applied consistently.
A cancelled purchase or a purchase returned for a change-of-mind refund before the draw will not qualify. An exchange for another eligible pair will retain the original entry without creating an additional entry.
Nothing in these terms limits rights under the Australian Consumer Law. Exercising a statutory right to a repair, replacement or refund for faulty goods will not, by itself, invalidate an entry.

10. Personal information
The Promoter will use entry details to administer the promotion, verify eligibility, contact the winner and arrange the prize. Information may be shared with service providers assisting with those tasks.
Entering does not subscribe an entrant to marketing. Any marketing consent will be requested separately and is optional.
Personal information will be handled in accordance with applicable privacy law. For privacy enquiries or requests to access or correct entry details, contact support@eyewearindex.com. The Promoter’s privacy policy is available at https://eyewearindex.com/pages/privacy-policy.
The winner’s name, photograph or other identifying details will not be used for promotional publicity without separate consent, except where disclosure is required by law.

11. Changes and consumer rights
The promotion will be conducted in accordance with these terms and applicable NSW law.
If an event beyond the Promoter’s reasonable control materially affects the promotion, any necessary change will comply with applicable law, be communicated promptly to entrants and preserve valid entries and the advertised prize wherever reasonably possible.
Nothing in these terms excludes or limits any consumer right or liability that cannot lawfully be excluded or limited.

12. Gucci affiliation
This promotion is conducted by Eyewear Index. It is not sponsored, endorsed or administered by Gucci. Gucci names and trade marks are used to identify the eligible products and prize.

Key Terms
The Promoter is Eyewear Index trading as Sunshades Eyewear (ABN 70 102 239 430) of 110 McEvoy Street, Alexandria NSW 2015. Entry is open to customers who has completed a product review in the Entry Period on a purchase they have made on www.eyewearindex.com. Entrants will receive an automated review email. To enter, each entrant must, during the Entry Period, click on the link incased in the automated email which will take them to the Eyewear Index review portal located at https://okendo.reviews/. Entrants will receive a review email, to enter click the link to leave a product review. Single entry will only. Entries which in the reasonable opinion of the Promoter: Are received outside of the Entry Period; Contain defamatory, offensive or inappropriate content or infringe intellectual property rights; Are incomplete or indecipherable; or do not otherwise comply with these terms, will be invalid and ineligible for any prize. This is a game of chance with a winner drawn at 12:00PM AEST on the first Monday of every month. Prize consists of a $100 Eyewear Index Gift Card. Winner will be notified by email and must accept the prize within 7 days of receiving this email, by completing the email address verification. If any prize is unclaimed or the winner drawn is not an eligible person for the purposes of these Terms and Conditions, a second chance draw will be held on the 8th of each quarter at the same time and place as the first draw(s) in order to distribute any unclaimed prizes. Winner will be notified in writing by direct email on or by 8th day of each quarter and the winner must accept the prize within 5 days of receiving this message, by completing the email address verification. If there is no prize winner or the prize winner cannot be located, this information will be published on the Promoter’s website.

Further Details

1. Entry is open to eligible Eyewear Index customers only.
2. If the winner of a prize is under 18 years of age, the prize will be awarded to winner’s parent or legal guardian.
3. Entries must be received by the Promoter during the Entry Period. Entries received after the close of the Entry Period will not be accepted.
4. This competition is a game of chance. Skill plays no part in determining the winner(s).
5. Prizes are not transferable and are not redeemable for cash, another product or gift cards. In particular, prizes may not, without the prior consent of the Promoter and any applicable third party supplier of the prize (“Supplier”), be resold or offered for resale at a premium (including via online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a prize is sold or used in breach of this condition, the Promoter or the Supplier may, at their absolute discretion, withdraw the prize(s). Where a prize has been withdrawn in accordance with this clause, no refund, substitute or compensation will be offered and if the prize is a ticket, the winner and any person who purchased or otherwise bears that ticket will be refused entry.

9. If an entrant’s contact details change at any time after the date which they enter the competition and the Second Chance Draw, that entrant must notify the Promoter of their correct contact details immediately.
10. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this competition. Verification is at the discretion of the Promoter, whose decision is final.
